Delivery Terms
X. Product Delivery
58. When placing an order, the Buyer can choose the method of product delivery, i.e., use the delivery service provided by the Seller.
XI. Delivery to the Address Provided by the Buyer
59. When choosing the delivery service during the order, the Buyer undertakes to provide the exact delivery location for the products.
60. The Buyer is obligated to accept the products personally. If the Buyer cannot accept the products personally, and the products are delivered to the provided address and based on other information provided by the Buyer, the Buyer does not have the right to make complaints to the Seller about delivering the products to the wrong person.
61. Products are delivered by the Seller or an authorized representative of the Seller.
62. The delivery cost depends on the delivery method chosen by the Buyer.
63. The Seller reserves the right to change the delivery fee and the minimum purchase amount for free delivery. The applicable rates are shown in the order form, allowing the Buyer to familiarize themselves with them before confirming the order.
64. Only the person who placed the order or the person specified at the time of order can pick up the products.
65. The Seller delivers the products to the Buyer based on the timelines indicated in the product descriptions. These timelines are preliminary and do not apply if the Seller’s warehouse does not have the required products, and the Buyer is informed about the shortage of the products they ordered. By confirming these Terms, the Buyer agrees that in exceptional cases, the delivery of products may be delayed due to unforeseen circumstances beyond the Seller’s control. In this case, the Seller is obligated to contact the Buyer promptly and agree on new delivery dates and conditions. If the Seller does not deliver the products within the additional timeframe, the Buyer has the right to exercise their right to cancel the purchase-sale agreement.
66. In cases where the purchase-sale agreement includes the transportation of goods and the Seller ships the goods to the Buyer, the risk of accidental loss or damage to the goods passes to the Buyer when they or their designated person, excluding the carrier, accepts the goods.
67. In all cases, the Seller is not liable for delays in delivery if the products are not delivered or are delivered late due to the Buyer’s or third-party fault or due to circumstances related to the Buyer.
68. At the time of delivery, the Buyer must check the condition of the shipment and products together with the Seller or the Seller’s authorized representative and sign the shipment receipt document. If the Buyer signs the receipt document, it is considered that the shipment has been delivered in proper condition, with no damages that can be attributed to anything other than factory defects, and the products are complete (as determined by an external inspection of the products). If the packaging of the delivered shipment is damaged (crushed, wet, or otherwise visibly damaged), and/or the products are damaged and/or incomplete, the Buyer must indicate this on the shipment receipt document.
69. Delivery costs in the online store are not included in the listed price and are specified as stated in Clause 49 of these Terms. Delivery via this method is free of charge for orders over 100.00 EUR. Free delivery is not available to the Neringa Municipality.
