Goods Purchase-Sale Rules

I. Definitions

1. The data controller and operator of the website www.energuscycling.lt (hereinafter – the Seller) is the Public Institution “Energus Cycling Team”, company code 306617260, registered office at M. Mažvydo g. 13-1, LT-06256, Vilnius, email address – veloteam@energus.lt.

2. Buyer – a legally competent natural or legal person who purchases goods in the online store at https://energuscycling.lt/.

3. Parties – Buyer and Seller together.

4. energuscycling.lt – online store with the web address www.energuscycling.lt.

5. Personal data – any information related to a natural person – a data subject, whose identity is known or can be directly or indirectly identified through data such as personal identification number, one or more characteristics related to the physical, physiological, psychological, economic, cultural, or social attributes of the person.

6. Product – anything sold in the online store energuscycling.lt. The terms “product” or “products” in these Rules refer to both singular and plural forms.

7. Return form – a standardized form that can be filled out to exercise the right to refuse goods.

8. Feedback – an open opinion provided by the Buyer who has purchased a Product on the website about the Product.

9. Rating – a score given to a Product purchased by the Buyer on the website, in a 5-star rating system.

10. Goods Purchase-Sale Rules (hereinafter – Rules) regulate the rights, obligations, prices of goods, payment procedures, delivery, warranty for product quality, returns, exchanges, and liabilities between the Buyer and Seller.

11. Privacy policy – a document approved by the Seller, outlining the main rules for the collection, storage, processing, and retention of Personal Data when using energuscycling.lt.

II. General Provisions

12. The following persons are eligible to use the online store’s services: 12.1. Legally competent individuals aged 18 years or older; 12.2. Minors aged 15 to 18 years with consent from their parents, adoptive parents, or guardians, unless they are independently managing their income or scholarship; 12.3. Legal entities; 12.4. Representatives authorized by any of the above persons.

13. If the Buyer wishes to use the online store’s services, they must choose one of the following options: 13.1. Purchase with registration; 13.2. Purchase without registration.

14. These Goods Purchase-Sale Rules, upon the Buyer’s approval (by reviewing the Rules and checking the box “I have read and agree with the website terms and conditions”), constitute a binding legal document for both parties, establishing the rights and obligations of the Buyer and Seller, the terms of goods purchase and payment, delivery and return procedures, liability, and other conditions related to goods purchase-sale in the online store.

15. The Seller reserves the right to change, amend, or supplement the Rules at any time, taking into account the legal requirements set by laws.

16. By agreeing to the Rules, the Buyer confirms that they have the right to purchase goods in the energuscycling.lt online store.

17. These Rules may be changed in accordance with changes in legal regulations. Every time the Buyer makes an order, it is recommended to review the Rules to ensure they fully understand the conditions of the specific order.

18. The Buyer must review the Seller’s approved Privacy Policy. Consent or refusal to specific uses of Personal Data must be expressed by the Buyer in the manner specified in the Privacy Policy.

19. If the Seller is required to send documents or information to the Buyer via email, the Buyer is responsible for providing a valid and functioning email address to the Seller.

III. Privacy Policy

20. VšĮ “Energus Cycling Team” conducts electronic commerce in compliance with the Personal Data Protection Law of the Republic of Lithuania, the General Data Protection Regulation (EU) 2016/679, and other legal acts concerning the processing, storage, and implementation of Personal Data.

21. The Privacy Policy is an integral part of these Rules.

IV. Products

22. The images of the products in the online store are for illustration purposes. Despite the Seller’s efforts to display the product colors as accurately as possible, the Seller cannot guarantee that the Buyer’s device screen will display the colors precisely. The Buyer understands that the products may slightly differ from their images.

23. The product packaging may differ from the images presented in the online store.

24. All products available in the online store are available for purchase. If the ordered products are out of stock, the Buyer will be immediately notified by email or other means (call and/or SMS) and the order for such products will be canceled.

25. The contract between the Buyer and the Seller is considered concluded when the Buyer, after selecting the product(s) and forming the shopping cart, clicks the “Order” link, and when the Seller contacts the Buyer by their provided phone number or email, confirming the order by sending a confirmation email.

26. Every purchase-sale contract between the Buyer and Seller is registered and stored in the online store’s database.

V. Buyer’s Rights

27. The Buyer may choose and order any product from the catalog of goods in the online store.

28. The Buyer has the right to review their Personal Data and request correction of incorrect, incomplete, or inaccurate data by sending an email to veloteam@energus.lt. In such cases, the Seller must promptly implement the Buyer’s request (within 1-2 business days).

29. The Buyer has the right to withdraw from the goods purchase-sale contract by notifying the Seller in writing, only if the product has not been damaged, its appearance has not been significantly changed, and it has not been used and remains in the original packaging.

30. It is prohibited for the same person to register and use the online store’s services under multiple names.

31. If the Buyer has purchased a product of inadequate quality in the online store, they have the right to demand that the Seller ensure proper product quality, proportionally reduce the product price, or unilaterally terminate the purchase-sale agreement.

VI. Buyer’s Obligations

32. The Buyer must pay for the goods and accept them in accordance with these Rules.

33. If the Buyer’s details change, they must immediately inform the Seller.

34. By using the energuscycling.lt online store, the Buyer agrees to comply with these Rules, other conditions clearly indicated on the website, and not violate the laws of the Republic of Lithuania.

35. The Buyer must immediately inform the Seller if the package is damaged, if incorrect products or quantities are delivered, or if the product is incomplete.

VII. Seller’s Rights

36. The Seller has the right to set a minimum order value, i.e., the minimum amount to be reached for the Buyer’s order to be processed. This amount will be displayed when reviewing the shopping cart.

37. If the Buyer attempts to harm the stability and security of the online store or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend their access to the online store or, in exceptional cases, cancel the Buyer’s registration.

38. The Seller has the right to cancel the order without prior notice if the Buyer does not pay for the goods within 5 (five) business days using the specified payment method.
